If a team is tied in Owners Points, the team with the highest season race finish gets the position
the most wins get the position, if still tied, then by 2nds, 3rds, etc.

PROVISIONALS - some news
A Possible Twist to the Top 35 Qualifying Rules: The plan to guarantee the top 35 drivers in car owner points starting spots in each race next year includes one provisional spot - for former Cup series champions. With former champions Terry Labonte and Bill Elliott running part-time schedules next year, that could come into play if they're outside the top 35 and don't earn one of the remaining spots on speed.(ThatsRacin.com)(11-13-2004) Provisional Rules to be changed? UPDATE: hearing after last weeks error with the provisonals being awarded that there may be a change somehow in the Provisional Starting Process. Lat week at Martinsville, #72-Kirk Shelmerdine was out of provisionals but was originally on the Starting Lineup. The #98 team of Todd Bodine protested and was added to the field and Shelmerdine dropped [in hindsight, since Shelmerdine was told he was in, they should had just added Boding and started 44 cars, however...]. Anyhow, hearing it could be like the top 40 speeds, and the remaining three 'promotors option' or the top three in owners points not in already with none being charged, however, this is just a rumor.(4-21-2004) UPDATE - rules change: NASCAR issued technical bulletins in its Cup and Busch series this week outlining a minor change to the awarding of provisional starting positions. The change concerns instances when there are not enough teams eligible for provisionals to fill the provisional starting spots. Previously, NASCAR would award the remaining positions to teams based on their number of qualifying attempts and all teams would be charged for using the provisionals. Under the revised rule, in the event the number of entries eligible for a provisional is equal to or less than the number of starting positions, provisionals assigned to fill positions 39 through 43 will not be charged to teams' maximum season total.(ThatsRacin.com), not much of a change and the rule pretty much already read like that anyway, anything to make the rule more confusing I guess. this is from a NASCAR PR dated 1-6-2004: "In the event the number of entrants is equal to or less than the number of starting positions available for an event, provisionals assigned to fill starting positions 39 through 43 will not count toward the maximum season allotment."...so what is the difference? So with 46 cars entered, no provisionals for #72-Shelmerdine [out], #00-Wallace or #04-McClure [first attempt for the teams] and while the #33 [Skinner] used a provisional and somehow was charged it at Daytona when it didn't have any, assuming [hate to assume] that the #33 with Kerry Earnhardt/team is NOT eligible for a provisional. So that should/could/maybe make 42 teams eligible for a provisional this week at Talladega, so they shouldn't be charged this week..... Been told, provisionals will NOT be charged at Talladega.(4-23-2004)
PROVISIONALS - THE RULES unofficial of course
What the heck is a provisional starting spot? A brief, simple explanation: Four provisional starting spots are available for positions 39-42. These positions are based on the current NASCAR Nextel Cup Series car OWNER points [first four races, the previous season points are used]. The 43rd and final starting position is available to any eligible past NASCAR Nextel Cup Series champion who fails to make the field through qualifying, starting with the most recent champion who participated in the previous season as a driver. If there are no eligible past champions, the 43rd spot will be filled through current NASCAR Nextel Cup Series car OWNER points, with the team highest in the OWNER points, not in the field, getting the spot.
Why does NASCAR use the provisional starting system? The theory, from what I am told, is that it protects the teams that attempt to make all the races. It allows a team to 'have a bad day' if they fail to qualify for the race or encounter problems.
How many provisionals per race? There are five provisional positions and a starting field to 43 cars every race. Four spots are awarded by the use of provisionals based on OWNERS points. The fifth is awarded to a past champion who has not OTHERWISE qualified for the race. If no past champ needs the provisional, the next team in the OWNER points will be awarded a provisional. 2004 - four plus 1 champ (if no champ used it, the next team in owners points got it) 2003 - six plus 1 champ (if no champ used it, the next team in owners points got it) 2002 - six plus 1 champ (if no champ used it, the next team in owners points got it) 2001 - six plus 1 champ (if no champ used it, the next team in owners points got it) 2000 - six plus 1 champ (if no champ used it, the next team in owners points got it) 1999 - six plus 1 champ (if no champ used it, the next team in owners points got it) 1998 - six plus 1 champ (if no champ used it, the next team in owners points got it) 1997 - four plus 1 champ (if no champ used it, the next team in owners points got it) 1996 - four plus 1 champ (if no champ used it, it went unused) 1995 - four 1994 - two before 1994 not sure how it was handled
How do team receive provisionals? Teams receive a provisional spot based on the teams position in the OWNERS points. OWNERS and DRIVERS points are different. Teams that use more then one driver during a season still generate OWNERS points for the same team/owner. Teams who have attempted ALL the Cup races get the provisional awarded first, then it goes down the order by attempts, then OWNERS points. When does a 'team' recieve' a provisional to use: Exisiting teams, the top 45 teams in Owners points from the previous year start with 4 provisionals to use. Any exisiting teams 46th or worse in the previous season and new teams do not have any provisionals to use until AFTER their first race attempt, they cannot use a provisional in that 4th race. When does existing top 45 team recieve a provisional? start off with 4 then get one after attempting their 6th, 12th, 18th, 24th, 30th and 36th races for a total of 10 provisionals they can use and be charged for, they can use as many as they can if NOT charged [see below on charged]. When does existing below 45 or new teams recieve a provisional? start off with 0 get 2 to use AFTER the 4th race attempt. then get one after attempting their 6th, 12th, 18th, 24th, 30th and 36th races for a total of 8 provisionals they can use and be charged for, they can use as many as they can if NOT charged [see below on charged].
How are provisionals awarded at the beginning of the season and how many provisionals do each team receive for the season? Car owners in the top 45 positions of the 2003 owner championship standings will receive four provisionals at the outset of the season and will receive an additional one after attempting to qualify for six events [if running a full 36 event season, the additional provisionals would be receieved at Bristol (3/28); Lowe's (5/30); Chicago (7/11); Bristol (8/8); Kansas (10/10); Homestead (11/21)] for a season maximum of 10. The previous season maximum was eight. New car owners and those not among the top 45 in the previous season owner standings are ineligible for provisionals until after their entry makes an attempt to qualify at four events. After attempting to qualify for four events, the car owner will receive two provisionals and additional ones can be earned by attempting to qualify for six events, with a season maximum of eight. Previously, those outside the top 45 and new car owners earned four initial provisionals following their first attempt to qualify for a race. Unused provisionals in the previous year are not carried forward to the next season.
How are provisionals charged against a team in 2004? Each provisional used by a car owner during the season – regardless of standing – counts against the owner’s season allotment earned. Previously, the top 25 car owners were not charged for provisionals used after the fourth race of the season. HOWEVER: In the event the number of entrants is equal to or less than the number of starting positions available [usually 43] for an event, provisionals assigned to fill starting positions 39 through 43 will not count toward the maximum season allotment.
How do the OWNERS get points? How do they differ from the DRIVERS points? All teams, who pass inspection and fail to make the race, get OWNER points based on the fastest non-qualifier to the slowest earn the position/points immediately below the last car in the field. These points will be included with those earned from the races to establish car/owner priority in gaining a provisional for the race. The driver get NO points for making an attempt, this is why OWNERS points and DRIVERS points for the same team will sometimes differ, if a driver misses a race. Points are awarded as follows: fastest who fails to qualify gets 31 points, then it goes in order: 28,25,22,19,16,13,10,7,4,1 - all remaining car owners get 1 point for the team race attempt. If a team/owner does not submit the entry form for a race before the entry deadline [usually 7-13 days], they are considered a POST ENTRY [denoted as an PE on race results] Teams that do NOT make the race are awarded OWNERS points, in order of fastest speed. Unless qualifying is rained out or cancelled. Then the OWNERS are awarded points by season race attempts. Ties are then broken by previous OWNERS points
No Provisionals are charged to any team, no matter where they are in the OWNERS POINTS standings IF: In the event the number of entrants is equal to or less than the number of starting positions available [usually 43] for an event, provisionals assigned to fill starting positions 39 through 43 will not count toward the maximum season allotment.
What happens if at least 43 cars attempt a race but more then one team is out of provisionals or not eligible yet [not enough attempts (4)] and fails to qualify for the race with still a spot open in the field? If one or a few of the teams without provisionals fail to get in on speed, then the part time teams (don't attempt all races and are deep in the OWNERS points) get a shot at the provisionals, lining up by Current Owners Points. If spots are still available, then the teams without provisionals get placed in the field by: 1) Number of Qualifying Attempts during the current season [regardless of the number of provisionals previosuly used] 2) Fastest qualifying speeds posted. Tie breakers [same attempts or speed], go to the team higher in current owners points. In this scernario, provisionals are NOT charged to any of the teams using them.
What happens if qualifying gets rained out? What about the Busch and Truck Series provisionals? Jayski does not keep track who uses provisionals in the Busch or the Truck Series, however, some news: The provisional starting positions procedure for the NASCAR Craftsman Truck Series will remain unchanged for the 2004 season. Also unchanged for 2004 in the NASCAR Busch Series will be the rule in which car owners who utilize a driver who is among the top 35 in the NASCAR NEXTEL Cup Series championship points will be ineligible for a provisional starting position.
The NASCAR Press Release about the 2004 Provisional Rules: Changes Announced in the Provisional System for 2004: The provisional system for the NASCAR NEXTEL Cup Series and NASCAR Busch Series will have several changes beginning with the 2004 season, NASCAR officials announced today. The most significant change in the system will increase the number of cars that make the 43-car fields via qualifying times, raising the total from 36 to 38. The move reduces the amount of provisional starting positions assigned to a field from seven to five. The “champion’s” provisional remains in place for the 43rd and final starting position when applicable. The other key change involves the eligibility for the provisional starting positions for new car owners and also those not among the top 45 in the owner standings. Those owners are ineligible for provisionals until after their entry makes an attempt to qualify at four events. After attempting to qualify for four events, the car owner will receive two provisionals and additional ones can be earned by attempting to qualify for six events, with a season maximum of eight. Previously, those outside the top 45 and new car owners earned four initial provisionals following their first attempt to qualify for a race.
