BDR not moving: Mike Brown, general manager for Bill Davis Racing [#22, #27, #36], says the team is not looking to move to the Charlotte [NC] area. The team, based in High Point, N.C., is one of the few Cup teams based outside the Charlotte area. Petty Enterprises announced last week it would move from Level Cross to Mooresville, N.C., after this season, in part to be able to be closer to the Charlotte area in hopes of attracting more crew members. “I understand what the Pettys are doing and if that’s right for them, that’s good,” Brown said. “Right now, we don’t see that as something that we’re entertaining.” Brown estimates that 25% of the team’s 300 employees are based in the Charlotte area. “We’re really happy with where we’re at,” Brown said.(Roanoke Times)(11-14-2007)

The 1997 Formula One world champion has been linked to a purchase of the team he is racing for since his manager Craig Pollock expressed an interest in buying a NASCAR team, but Villeneuve claims that he will not be involved in any takeover bid. Villeneuve said: "Over the last few weeks there has been persistent speculation that I am considering some form of purchase of the Bill Davis Racing organisation. "In spite of my consistent denial of these claims, the questions and speculation continue, so I want to set the record straight, one time only. I am not interested in buying the BDR business, or any other NASCAR team. I have not been considering such a purchase, and I will not be changing that position." Bill Davis Trucking Files for Bankruptcy: Bill Davis Trucking Inc. of Batesville, Ark. has filed for Chapter 11 bankruptcy protection. Bill Davis, company president, is widely known as owner of a NASCAR team. The company's attorney, Geoff Treece of Little Rock, declined to comment on the pending case. A meeting with creditors is scheduled for Dec. 18, according to an Oct. 22 filing in the U.S. Bankruptcy Court for the Eastern District Arkansas in Batesville. Chapter 11 allows restructuring of debt so that a company can continue to operate. A list of assets and liabilities is not currently available. The deadline for filing that is Nov. 6. Davis also owns Bill Davis Racing, based in High Point, N.C. It had been speculated that his NASCAR team would potentially be sold or bought into.(Arkansas Democrat-Gazette) Statement From Bill Daivs Racing: Bill Davis Trucking, Inc., founded in 1975 by Bill and Gail Davis, announced it has filed for Chapter 11 bankruptcy protection. Latest on Bill Davis Team Sale: UPDATE: Jacques Villeneuve has apparently completed a buy-in of Bill Davis' High Point-based Toyota operation, according to sources close to the team, and Villeneuve will have at least a majority interest in the operation, perhaps even full ownership. Last Sunday, when asked about the report of a planned Villeneuve buy-in, Davis said he wasn't in a position to give a specific answer but did say he was considering a number of options. It is unclear what a purchase price might be. It is also unclear why Villeneuve, who lives in Montreal, would want to buy a NASCAR team, or if Villeneuve might move the team from High Point, where Davis has operated for more than 15 years.(Winston Salem Journal)(10-27-2007) UPDATE: What Villeneuve might be doing in NASCAR is still a subject of debate. According to some familiar with the situation, Villeneuve may be coming into the sport for a short-time run as a driver but as a long-term run as an investor/owner. Just what role NASCAR executives might have in this is unclear, though obviously NASCAR is the big winner in the deal, which enhances their new Canadian venture. Last year, Villeneuve and Pollack began talking about setting up their own NASCAR operation and talked with Ford's Jack Roush and Geoff Smith about a deal for cars, engines and start-up stuff. But it never got very far. Pollack talks about interest of buying BDR: Jacques Villeneuve's manager Craig Pollock says he is interested in buying a Nextel Cup team while admitting he has held talks with Bill Davis Racing, the team for which his driver is currently competing in NASCAR. The former Formula One team principal and Champ Car team owner said in an interview with Le Journal de Montreal that he has held talks with a number of Nextel Cup teams, evaluating different options to become involved as a team owner. Pollock is understood to be in serious talks with Bill Davis to buy equity in his NASCAR squad, which currently fields two cars in Cup and three in the Craftsman Truck Series. Jacques Villeneuve is expected to race for the team in the NASCAR Sprint Cup next year."I'm interested in having an active participation in a NASCAR team, preferably the one where Jacques drives," said Pollock. "It's the best way to make sure that my driver has access to the best equipment available." It had been reported during the weekend at Martinsville and on Canadian radio that Jacques Villeneuve was the one actually buying BDR, something that Pollock categorically denies. "Jacques has never spoken with a team with the intention to invest in it," he added. Scott Riggs was recently signed to drive for the team in 2008. Dilner also mentioned that Tony Furr could ended up back with Haas as Mayfield's crew chief, but Furr denied that.(10-22-2007) UPDATE 2: Jeremy Mayfield will replace Jeff Green in the Haas CNC Racing #66 Chevrolet, effective immediately, team general manager Joe Custer said Monday morning.
Mayfield also will join Scott Riggs in the driver lineup for next season but the alignment of the two drivers with car numbers in 2008 has not been determined, Custer said. Green is 27th in the series points standings. "[Green] did a good job for us, and we appreciate everything he did," Custer said. His replacement in the #36 Bill Davis Racing team for this weekend at Atlanta has not been announced. According to a reliable source, Villeneuve and his business manager since 1992, Craig Pollock, have recently purchased Bill and Gail Davis' stock-car racing team. This is the team that currently runs Villeneuve in the Craftsman Trucks series and in the Nextel Cup. That doesn't mean he won't. The owner of Bill Davis Racing said several parties have expressed an interest in purchasing his company that includes two Nextel Cup cars driven by Dave Blaney and Jeremy Mayfield, who will be replaced by Formula One star Jacques Villeneuve next season. "Like any team our size, we have to be realistic and look at all of our options with what's going on in the sport right now," he said before practice at Martinsville Speedway. Latest news on Three Sixty Inc./360 OTC: Morgan-McClure Motorsports is one of two auto racing companies suing an Athens firm that markets a hangover relief pill for failing to live up to sponsorship agreements. The suits allege breach of contract and fraud against Three Sixty Inc., which distributes over-the-counter hangover relief medicine 360 OTC. Other defendants in the suits are Three Sixty's subsidiary Rockford-Montgomery Labs Inc., Rockford-Montgomery company officers Michele Shearer and Mark De Mattei and Air, Sea and Ground Inc. an advertising agency run by De Mattei. The lawsuits are just part of the trouble for the apparently beleaguered company. Three Sixty announced in a news release Thursday that Shearer had resigned as president of the company, after serving as president and CEO of the company only since May. Shearer founded Rockford-Montgomery Labs, which created the 360 OTC brand. Virginia-based Morgan-McClure's suit, filed in the U.S. Northern District Court of Georgia, claims that Rockford-Montgomery failed to make payments on a $10.1 million race team sponsorship agreed to in 2006 for the 2007 season. The suit further alleged that Rockford-Montgomery signed up for another sponsorship with the Bill Davis Racing team, a competitor of Morgan-McClure and that Rockford-Montgomery attempted to terminate the agreement with Morgan-McClure without valid cause. De Mattei, as an agent for Rockford-Montgomery, sent a letter of termination in November to Morgan-McClure saying the racing company failed to hire a race car driver in time for Rockford-Montgomery to come up with a marketing plan. Dirt Motorsports, a Delaware company that sponsors the World of Outlaws racing tour, filed suit in August in the U.S. Middle District Court of Georgia against Shearer, De Mattei, Three Sixty, Rockford-Montgomery and Air, Sea and Ground Inc. Dirt Motorsports' lawsuit charges breach of contract and fraud, and claims Three Sixty and the others failed to pay for $4.8 million in sponsorship agreements. Among several charges of fraud, the suit said De Mattei and Shearer knowingly made false claims that Air, Sea and Ground was managing a $65 million advertising campaign for Rockford-Montgomery.
In a related matter involving the Morgan-McClure suit, Athens attorney Roy E. Manoll III with Fortson, Bentley and Griffin, who had been hired as counsel for Rockford-Montgomery, withdrew from the case in September. Manoll wrote to Shearer that Rockford-Montgomery had not paid past legal fees, and he could not continue to work on the case with Rockford-Montgomery owing "significant" past due bills. Motorsports marketing agency Just Marketing International, an Indiana-based firm, also filed suit in Clarke County Superior Court this summer against Rockford-Montgomery, Three Sixty, Shearer and De Mattei for nonpayment on a marketing program that Just Marketing worked on for Rockford-Montgomery. Drivers Don't Like Villeneuve Debuting at Talladega: #24-Jeff Gordon thinks it's a big mistake for former Formula One champion Jacques Villeneuve to attempt to make his Nextel Cup debut next week at Talladega Superspeedway. "I love Jacques, but that's not the right decision to make," Gordon said Friday. "I didn't think it was the right decision last year for David Gilliland, either. Nothing against their talent or anything else, but that race in the Chase? Why? If you want to run a race, go to Atlanta or another 1.5-mile oval." Gordon said he was surprised NASCAR gave it approval for Villeneuve to debut on the giant 2.6-mile oval. Villeneuve to attempt Talladega: Jacques Villeneuve will make his Nextel Cup race debut next weekend, five weeks earlier than originally planned, in the ‘UAW-Ford 500’, at the famous Talladega Superspeedway in Alabama. Villeneuve, who sat in a ‘Cup’ car for the first time just 24 days ago, was initially scheduled to race the ARCA and Craftsman Truck races at Talladega – steps one and two on the NASCAR ladder – whilst watching the main ‘Cup’ event on Sunday, along with over 143,000 trackside spectators. Villeneuve’s fast-track to ‘Cup’, the top step of the NASCAR ladder, has been made possible only with the approval of NASCAR. His recent performance in his debut ‘Car of Tomorrow’ test, also at Talladega, where he ran more laps than any other driver, and successfully ‘bump-drafted’ his way through the pack, without making enemies of the more experienced drivers, is seen to have eased that same process of approval. Having made his NASCAR race debut in the Craftsman Truck event at Las Vegas just last weekend, Villeneuve now faces a new challenge, where he will again be focused initially on qualifying his #27 car (43 cars will start the race, of which 36 are guaranteed a place based on pre-earned team points – Villeneuve does not have the benefit of such team points, either earned or inherited). In addition to Sunday’s 500-miler, Villeneuve will contest Saturday afternoon’s Craftsman Truck event, the 94-lap ‘Mountain Dew 250’, which is exactly half the length of Sunday’s flagship ‘Cup’ race. Effective as of September 14, 2007, Michelle E. Shearer has resigned as President & CEO of the company. Ms. Shearer, as President of Rockford-Montgomery Labs, Inc., also rescinded the share purchase agreement of Three Sixty, Inc. thus rendering the company without the asset stated. The company, after careful review with advice of counsel, accepted Ms. Shearer's action without objection as the company believes it was in the best interest of the shareholders and the company. The company has since nominated a new President & CEO that will take the company in a new and more potentially lucrative direction in the aviation arena. In the coming weeks the company will change its name to IAH Corporation with a new trading symbol of which will better reflect the new direction of the company. Mayfield's team expects 'big penalties' from infraction UPDATE: Joe Lax, crew chief for Jeremy Mayfield's #36 Toyota, is expecting a significant penalty after his team got caught putting illegal weight in the car. In pre-qualifying inspection Friday at California Speedway, Mayfield's Bill Davis Racing car was found to have too much camber in the rear end. The team fixed the problem, which requires taking a blowtorch to the rear of the car, and went back through the inspection line, but the car was found to be too light on the right side. Then, in a moment of desperation, a team member stuck a piece of lead inside the water bottle to add the extra weight. But NASCAR discovered the illegal trick, which is considered tampering with the car.(SceneDaily.com)(9-1-2007) UPDATE: Joe Lax, crew chief for the #36 Toyota driven by Jeremy Mayfield in the Nextel Cup Series, has been fined $25,000, suspended from NASCAR competition until Sept. 19 [2 races] and placed on probation until Dec. 31 due to rule violations last week at California Speedway. Prior to qualifying, Lax was found to have violated Sections 12-4-A (actions detrimental to stock car racing); 12-4-Q (car, car parts, components and/or equipment not conforming to NASCAR rules); 20-2.3 (added car weight); and 12-4W (improperly attached weight; weight installed inside water container). Villeneuve tests COT at Kentucky: Jacques Villeneuve continued his preparation for his NASCAR debut by testing Wednesday at Kentucky Speedway. He turned laps for Bill Davis Racing in the new Car of Tomorrow [#27 Toyota]. “Feels great! I’m just getting up to speed and getting used to driving the car,” said Villeneuve during a lunch break. “It is very different than anything I have driven before so I just want it to become natural and its fun.” Villeneuve will use the final seven races of the 2007 Craftsman Truck Series season to prep for Sprint Cup Series competition in 2008. Even though the race trucks and the COT have similar aerodynamics, both are very different from what he has driven in the past. “It is not as responsive. But, the tracks are very different as well. The driving style is different. If it was on a similar type than there would be a huge difference.” Testing continues through-out the fall at the 1.5 mile tri-oval. BDR hires race engineer for Villeneuve: Ryan Coniam has been hired as race engineer for Jacques Villeneuve in the 2008 Nextel Cup Series. Villeneuve, who was world driving champion in 1997, will start his NASCAR career at Las Vegas Motor Speedway on Sept. 22 when he will partner Bill Davis Racing teammate Mike Skinner in a Craftsman Truck Series race. Villeneuve is expected to drive as many as seven truck races and possibly one Nextel Cup race in ’07 before going into the Cup series full-time in 2008. The 27-year-old Coniam, former World of Outlaws sprint car star and son of Canadian Motorsport Hall of Fame inductee Warren Coniam, has been living in Mooresville, N.C., where he was employed in research and development for Dale Earnhardt Inc. He was head-hunted by BDR and travelled to Bristol, Tenn., for an interview the weekend of Aug. 25. He was notified last Friday that he has the job. Villeneuve will drive truck #27, renumbered in recent days by BDR to honour Villeneuve’s late father, Gilles Villeneuve, who drove Ferrari #27. BDR sponsor 360 OTC facing lawsuits: Team owner Bill Davis said last week that he doesn't expect 360 OTC pain relief products to return as a sponsor of his #36 Nextel Cup entry next year. There could be a possible reason: The company that distributes 360 OTC, Rockford-Montgomery Labs, is involved in its third lawsuit concerning motorsports sponsorships. Dirt Motor Sports, which operates the World of Outlaws, is suing Rockford-Montgomery Labs for non-payment of its title sponsorship of the World of Outlaws Late Model Series. The deal was worth $1.5 million in 2007, $1.6 million in 2008 and $1.7 million in 2009. According to the lawsuit, filed in U.S. District Court in Georgia, Rockford-Montgomery Labs never paid the bill. A check for $150,000 bounced in February, according to the court record. Just Marketing, which was under contract to develop and manage a motorsports marketing program for Rockford-Montgomery Labs, has sued the company for non-payment. Morgan-McClure Motorsports also is suing the company over a $10.1 million sponsorship deal signed in June 2006 for 2007, which Rockford-Montgomery Labs later backed out of citing poor performance, the lack of a driver and the lack of time to prepare promotional materials. RML later announced its sponsorship of BDR. Villeneuve tests truck at Chicago, debut at Vegas, could run Cup race UPDATE: Jacques Villeneuve, the 1997 Formula One champion and 1995 Indianapolis 500 winner, will drive seven races in the NASCAR Craftsman Truck Series for Bill Davis Racing in anticipation of racing full time next season. Villeneuve tested in a Craftsman truck [the #27 Toyota], which uses a stock-car chassis with a pickup body, in Chicago on Monday. He is expected to make his debut on the third-tier NASCAR circuit at Las Vegas Motor Speedway Sept. 22. "It's possible he may run a Nextel Cup car at the end of the year."(Detroit Free Press)(8-28-2007) UPDATE: Former Formula 1 World Champion Jacques Villeneuve made his debut behind the wheel of a Bill Davis Racing Toyota Tundra machine Monday and Tuesday at Chicagoland Speedway. Villeneuve, who has not raced on an oval track since 1995, when he won both the Indianapolis 500 and the CART Indy Car Championship, spent Monday acclimating himself to the #27 truck. After watching teammate Mike Skinner run a few laps, Villeneuve hit the track in his Tundra. By his 12th lap, Villeneuve's lap time was 31.67 seconds [170.508mph] around the 1.5-mile tri-oval and within six tenths of a second of Skinner's times. Villeneuve finished the day only two tenths of a second slower than the Craftsman Truck Series Championship leader. The team made a number of changes to the truck throughout the two-day test session, but Villeneuve never slowed. His lap of 31.00 seconds [174.194mph] Tuesday proved to the other Craftsman Truck Series teams attending the test just how talented he really is. "It was a great test," Villeneuve said. "I missed racing on ovals, so it has been a lot of fun the last few days. I definitely learned a lot. The truck has a lot more grip then I thought it was going to have. It turns very well. It took a little getting used to at first, but I am very comfortable in it now."
"Jacques did very well," said BDR Truck Team Manager Mark Chambers. "He gives incredible feedback and adapted to the truck extremely well. Villeneuve could be headed to Cup in 2008: Bill Davis Racing plans to field a full-time Sprint Cup entry for former Formula One world champion Jacques Villeneuve in 2008, team owner Bill Davis said Friday at Bristol Motor Speedway. Davis said the plan right now is to run Villeneuve in the #22 Craftsman Truck Series entry later this season, as well as test the Car of Tomorrow. BDR will also field a car for Villeneuve in the ARCA race at Talladega in October in preparation for the Daytona 500 in 2008, Davis said. Then? "And then we'll go Cup racing next year," Davis said. Davis said that Villeneuve's jump to Cup doesn't necessarily mean he'll be in the #36 Toyota and that a three-car team "is a possibility." Veteran Nextel Cup crew chief Slugger Labbe will lead Villeneuve's team, Davis said. Villeneuve will debut in NASCAR during a CTS test at Chicagoland Speedway on Monday. Mayfield looking for new gig, could stay at BDR: Bill Davis Racing's #36-Jeremy Mayfield, who will not return to the team in 2008, said he has no particular options right now. While he'd like to continue racing in the Nextel Cup Series, Mayfield says that he would consider the Busch Series and Craftsman Truck Series if that's what it took to land a competitive ride. Mayfield said that he and the team decided to announce a split at season's end while everyone was still getting along well. "It's a good mutual deal, nothing bad and nothing's wrong at all," he said. "Who knows, we might run good the rest of the year and end up staying together, but we don't know that." Mayfield doesn't have any offers in the works right now and says that if his team started performing well, he could even end up back at BDR. He's not interested in signing with a Cup team that isn't competitive just to stay in NASCAR's elite series. "My whole intentions are to stay in the Cup deal, but what I want to make sure that it's with a good team that can run up front and get the job done," he said. "If it's not a good team, I'm not going to just drive anything in Cup. The team also failed to build continuity or momentum, going through several crew chief changes in an attempt to find the right chemistry. Team owner Bill Davis said Mayfield had "done all we asked of him and more' as the team took on the challenge of Toyota's first season in the Nextel Cup series and adjusting to the Car of Tomorrow template. But Davis still decided to make a change.
"We have had great support from Toyota on this endeavor, but it takes more than just manufacturer support to compete on this level," Davis said. "It takes a tremendous amount of additional sponsorship support that just did not materialize as we had anticipated. I've been in this sport long enough to know that it takes time to bring a brand new car up to speed in what is probably the most competitive racing series in the world," Mayfield said in the team's news release. Changes at the #36: Joe Lax has been tagged to lead the #36 360 OTC Bill Davis Racing team and driver Jeremy Mayfield after David Hyder left the team [to go back to the #49 BAM Racing team] following the event at Chicagoland Speedway. Lax previously served as a shock specialist at Bill Davis Racing. In addition, engineers Garth Finley and Dax Gerringer have swapped teams. Finley now works with the 360 OTC Racing team, and Gerringer has moved to the #22 Caterpillar Racing team. Brad Tunny will take over car chief duties from Mike Cooper, who will now stay back at the High Point, N.C., shop. Gary Grossenbacher will travel with the team this week and will serve as lead engineer for both BDR Cup teams. Lax and his wife Suzanne welcomed son Jacob Julius into their family Tuesday, July 17. Dave Blaney will be joined this weekend at Bill Davis Racing by road racer Butch Leitzinger who will drive the #23 Caterpillar Racing entry at Infineon Raceway. Jeremy Mayfield will return to his regular ride in the #36 360 OTC Toyota next week at [Loudon] New Hampshire International Speedway. Leitzinger has made three starts in Nextel Cup Series competition - all at Watkins Glen International -
and has finished as high as 12th. Leitzinger takes a break from his American LeMans Series driving duties with Dyson Racing to compete in the event at Infineon Raceway for BDR. The 38-year old from Homestead, Pa., has won the 24 Hours of Daytona three times, the World Sportscar Championship twice and both the CanAm Championship and IMSA GTU Championship. He has also posted three victories in NASCAR's Busch North Series and a podium finish in the Busch Series event at Watkins Glen International. The #22 Caterpillar Toyota Blaney is scheduled to drive this weekend at Infineon Raceway is COT 11. The team has tested this Toyota Camry at Virginia International Raceway twice during the last several weeks in preparation for this event. Hyder gets new gig, crew chief for Mayfield UPDATE: Crew chief David Hyder, fired from Michael Waltrip Racing last month, will return to the pit box next weekend at Dover International Speedway to guide the #36 Toyota driven by Jeremy Mayfield, Bill Davis Racing competition director Tommy Baldwin told ESPN.com Saturday. Hyder is already working in the BDR shop, preparing a car to test Tuesday at North Carolina Speedway in preparation for Dover, Baldwin said. Hyder was fined $100,000 and suspended indefinitely by NASCAR in the first week of the season after an illegal substance was found in the carburetor on the #55 Toyota prior to qualifying.
NASCAR will lift the suspension on May 30, opening the door for Hyder to join BDR. Baldwin is relieved to bring Hyder on board. He'd been pulling double duty since March, serving both as crew chief for Mayfield's team and as the organization's competition director. "Thank god," Baldwin said with a grin. "It's time for me to focus on the future of this organization." Hyder spent two years in that capacity at BAM Racing before moving to the Wood Brothers Organization in 2006, working with Ken Schrader in the Cup Series and with Jon Wood in the team's Busch Series program before heading back to BAM Racing to finish out the 2006 season. Hyder began the 2007 campaign at Michael Waltrip Racing. "It's good to be back and it's great to have an opportunity like this one," said the 39-year-old Hyder. "I have a great deal of respect for Bill Davis. He's been in this sport for a long time and has shown he knows what it takes to win. He began his tenure in NASCAR at Petty Enterprises and spent over four years with that organization serving as the car chief for the #43 and #45 Cup teams. Morgan-McClure sues 360 OTC: #4-Morgan-McClure Motorsports has sued 360 OTC parent company Rockford-Montgomery Labs in federal court in Atlanta. The team claims that it signed a $10.1 million deal for the company to sponsor Morgan-McClure's #4 car in 2007. Because of the sponsorship, McClure planned on running two cars next season and had outlined a tentative agreement with driver Johnny Sauter, according to the lawsuit and the accompanying documents. The sponsorship deal was signed June 14, 2006, but 360 OTC announced on Aug. 25, 2006 that it would sponsor Bill Davis Racing's #36 team and driver Jeremy Mayfield. In its complaint, Morgan-McClure claims the team was assured that Rockford-Montgomery Labs would still continue with its Morgan-McClure obligations in addition to the BDR commitments. With that knowledge, according to the suit, Morgan-McClure pursued a deal with Sauter, who was driving in the Busch Series for Haas CNC Racing last year. The deal was worth $450,000 in base salary plus 35% of all winnings and 33% of merchandise sales. Rockford-Montgomery Labs then told Morgan-McClure it would terminate the sponsorship agreement Nov. 1 citing poor 2006 performance, the lack of a driver and the lack of time to prepare promotional materials. The company has not paid Morgan-McClure any money, according to the complaint. Because the sponsorship did not come through, Morgan-McClure could not commit to Sauter, who wound up staying at Haas CNC Racing and driving a second Nextel Cup car for the team this year. In its response, Rockford-Montgomery Labs denies most of the allegations. It also states that McClure sent an e-mail to the company in late October saying it had not been able to finalize a deal for Sauter. The sponsorship deal was for one year with three one-year options at the same $10.1 million per year. Team owner Larry McClure and Sauter declined comment. Wimmer suing Davis: Scott Wimmer filed a lawsuit earlier this week against Bill Davis Racing, claiming he is owed $1.2 million in salary for the 2006 season because the team did not follow the procedure in the contract to fire him. In the suit filed Monday in North Carolina Superior Court in Greensboro, N.C., Wimmer alleges BDR did not tell him until Oct. 24, 2005, that he would not be the driver in 2006. He claims that violated a clause in the contract which states that if the driver is not in the top 25 in the standings by Sept, 1, "team shall have the right to issue a written notice that driver is being placed on a 30-day notice stating that performance level must be improved to the satisfaction of sponsor and team by September 30th of current year or team may issued [sic] a written notice of termination of driver agreement at the end of current Nextel Cup season." Wimmer claims he received no written notice, that the team told the media around Oct. 8 that he would return in 2006 but then sent him a termination letter Oct. 24. According to the lawsuit, Wimmer was being paid $600,000 for the 2004 season, $900,000 for 2005 and $1.2 million for 2006. He also received 45% of prize money as well as 33.3 percent of royalties from team merchandise. Wimmer drove in Nextel Cup for Morgan-McClure Motorsports for much of the 2006 season. 360 OTC leaves World of Outlaws as title sponsor UPDATE 2: World Racing Group announced today, effective immediately its national late model touring series will be known as the World of Outlaws Late Model Series, removing 360OTC as title sponsor. “We enthusiastically promoted the 360OTC brand and were delivering, and even over delivering, on our obligations in the partnership,” said World Racing Group CEO Tom Deery. “Unfortunately, Rockford-Montgomery Labs and its 360OTC brand were not able to live up to its responsibilities and obligations and we are effectively ending the sponsorship.(WoO site), no word how or if this effects sponsorship of the #36 Bill Davis Racing Nextel Cup team of Jermey Mayfield or the BDR Truck Series team of Tyler Walker. "By no means are we slowing down with that team," Baldwin said. "But reality is reality. You don't make races you're going to be out of business. Any team. Not just the 36. We're certainly not in that position right now." Driver Jeremy Mayfield has yet to qualify for a race this season, spawning speculation that the team was in peril. "The reality of it is we've missed the first four races," Baldwin said. "It's been a hard thing to swallow as a race team. We've just got to keep working with the 36, figure out what Jeremy really wants [in the car]." Baldwin explained that Mayfield's driving style is vastly different than that employed by Dave Blaney, driver of BDR's #22 Toyota. As a result, what he wants to feel at the wheel is also quite different. "Jeremy's a finesse driver," Baldwin said. "He feels a lot of things in the steering wheel. Some things he doesn't like compared to Dave -- Dave can just drive through the situation where Jeremy is feeling a lot of things and it's making him uncomfortable. "The team is close. The people working on it are doing a really good job. The car is prepared really well. The car is built right. But I don't know if it's being they're built to Jeremy's liking. Being associated with Jeremy in the past [at Evernham Motorsports], there were some differences we had to do back then between the two drivers. It's pretty much the same here, we're finding out." To combat the situation, Baldwin said cars dedicated to Mayfield are being cut up and rebuilt. He said they went to the wind tunnel Thursday and will go twice more in the coming two weeks. Baldwin said Toyota is doing everything it can to assist BDR's development, and that Mayfield is fully engaged and handling it well. What about him? Is it time for a full time return to crew chief? UPDATE 2: was told about a report on a local racing radio show, Gary Danko's Speedway Line Report, a 90 minute show [WATR 1320AM out of Waterbury CT] where Jeff "The Jet" Zarella of the #15 DEI team said that he is hearing that the #36 360 OTC Toyota team of Bill David Racing, that Jeremy Mayfield drives for, could shut down soon, and said he had heard that if the #36 didn't make last weeks race at Atlanta, the team would not run at Bristol. UPDATE 2:XM Radio's Claire B. Lang had #36 car owner Bill Davis on the phone last night for an interview and he adamantly denies any rumors of shutting down Jeremy Mayfield's team. Said it was just something someone on the 15 team said on radio and there is absolutely no truth to it. And Mayfeild says on a podcast on the 360 OTC site that that he was in the shop Tuesday with crew chief Tommy Baldwin and is looking forward to going to Bristol and was getting ready to leave for the track. And the updated Entry list came out from NASCAR on Thursday, Mayfield is still entered and listed in the #36 360 OTC Toyota.(3-22-2007)

"We're fortunate to have someone like Tommy, with his record as a crew chief and his abilities as a team leader, available within our organization in situations like these," stated team owner Bill Davis. "Derrick Finley has been an integral part of the Bill Davis Racing family for several years and will remain with us serving in a different role. Obviously, the 360 OTC Racing team has struggled in the early stages of the season and we felt it would be in the best interest of the team and our sponsors to make the change." During this time, Baldwin's main priority will continue to be serving as Competition Director for all of Bill Davis Racing's Nextel Cup teams and assuring BDR's growth as an organization. Finley named #36 crew chief, also many addtions to organization: Bill Davis Racing (BDR) announced that Derrick Finley will serve as crew chief for the #36 OTC 360 team and driver Jeremy Mayfield. In addition, the team has added several key employees to
its organization. Finley, 35, began his tenure at Bill Davis Racing near the end of the 2003 season and was chosen to become the crew chief of the #22 Caterpillar team for the final two races of the 2004 campaign. Finley spent 2005 calling the shots for that team before moving to the #55 [Michael Waltrip] team for the 2006 season. Midway through 2006, Finley returned to his engineering roots and became a key part of both the #55 and #22 teams' efforts. Finley will pair up with veteran driver Jeremy Mayfield in 2007.
In addition, Bill Davis Racing has added several key employees to its roster. Gene DeHart has been called upon to oversee the team's speedway program. DeHart most recently was involved with DeHart, Inc., using his expertise hanging bodies and building Chassis for various Nextel Cup, Busch and Truck Series teams. Prior to that he was with Kevin Harvick, Incorporated.
Gary Grossenbacher has also joined BDR and will function as the Cup program aerodynamicist. Grossenbacher spent the past three years working as the Technical Director for Synergy Racing in the Grand American Sports Car Series. Before that, Grossenbacher worked for G2 Inc., on its General Motors Motorsports Technology Group contract, which included engineering design, manufacturing,
application and support of NASCAR suppliers and race teams.
Veteran crew chief Gene Nead has also been hired by Bill Davis Racing. Nead comes to BDR from Kevin Harvick, Inc. where he guided the #77 Busch Series team. At BDR Nead will oversee research and development as well as lead the ARCA RE/MAX and Busch Series programs for BDR driver Bobby Santos.
The engine department has added the knowledge and skills of Dr. Andrew Randolph. Dr. Randolph received his Ph.D. in Chemical Engineering from Northwestern University in 1985. During a 22-year career at General Motors and in NASCAR, Dr. Randolph's work has ranged from fundamental engine research to mass-production engine development and from Wankel rotaries to Pro Stock drag engines. In the process he has become one of the world's foremost authorities on combustion analysis. He has contributed to five NASCAR Cup championships with three different teams. It will be the first race held at the speedway since the banking in the turns was raised from 12 to 20 degrees and the pit road was moved 275 feet closer to the grandstands. Mayfield will drive the #15 Chevy for Billy Ballew. Ballew is no stranger to Victory Lane in the Truck Series or at LVMS. Mayfield most recently competed for Evernham Motorsports. The 37-year-old driver, who hails from Owensboro, Ky., has made 402 starts at NASCAR's highest level and was a contender in the Chase for the Championship during both the 2004 and 2005 seasons.

Mayfield made his first Cup Series start in 1993 before teaming with Cale Yarborough the following season. He remained with that team through most of the 1996 season, before uniting with car owner Michael Kranefuss, who eventually joined forces with Roger Penske in 1997. Mayfield spent the next four seasons with the Penske organization. He scored his first career victory at Pocono (Pa.) Raceway in 1998, and went on to finish seventh in the championship standings that year. Mayfield earned two more victories in 2000. He joined Evernham Motorsports beginning with the 2002 season, where he continued to prove his talent by winning races in 2004 and 2005. Mayfield has five NEXTEL Cup victories under his belt, has started from the pole position nine times and has posted 96 top-10 finishes throughout his career.
Blaney, a Hartford, Ohio, native, has been behind the wheel of the Caterpillar car the entire 2006 season. His first partnership with Bill and Gail Davis came back in 1998, when Blaney drove part-time in the NASCAR Busch Series. He joined the Cup Series in 2000 and remained with Bill Davis Racing through 2001. After departing to race for Jasper Motorsports in 2003, he returned to BDR to drive part-time in the Cup Series in 2004. In 2005, Blaney was invited drive for Richard Childress Racing, where he posted two top-10 finishes. In all, Blaney has made 222 starts in NASCAR's premiere series and has captured one pole position and 19 top-10 finishes during his tenure.

Mayfield, a native of Owensboro, KY, and former ARCA Series Rookie of the Year, has competed in the NASCAR Nextel Cup Series since 1993. "I just want to race," said Mayfield. Mayfield claims Evernham's absence hurt team: Jeremy Mayfield claims in court documents that team owner Ray Evernham's "close personal relationship" with development driver Erin Crocker distracted his team and kept the owner from being an instrumental part of the No. 19 Nextel Cup team, whose struggles this year eventually led to Mayfield's firing. Mayfield made that allegation in his lawsuit against Evernham Motorsports filed Aug. 9 in North Carolina Superior Court in Iredell County after Evernham Motorsports informed Mayfield Motorsports Inc. on Aug. 7 that Mayfield would not drive the car in the Aug. 13 race at Watkins Glen. More news on Mayfield: It has been reported that Jeremy Mayfield (released by Ray Evernham Friday) might be in the #38 Robert Yates Racing Ford beginning this week at Michigan. Mayfield certainly seems to be available. However, it appears David Gilliland, who has been working his way through the junior NASCAR ranks, is going to be the choice come next season for Yates and it has also been reported he could step into the car immediately with Elliott Sadler, already reportedly hired by Evernham for the #19 car next season, starting his new job next week [at MIS]. Some have said that Gilliland, who has not been approved for superspeedways including Talladega coming Oct. 8 during The Chase, might want to protect his rookie status for next year. Some in the know have said it’s not his decision but it’s up to Yates as to whether he wants the new kid to run for rookie honors in 2007. Meanwhile, there’s also was the suit filed by Mayfield to try to keep his ride with Evernham. Latest on the Mayfield-Evernham legal battle: Jeremy Mayfield's immediate legal challenge to the terms of his firing by Evernham Motorsports has been resolved. Mayfield, who was released Monday, filed the request for an injunction in North Carolina Superior Court in Iredell County. Whether he could have gotten in the #19 car Friday is unclear as Bill Elliott pracaticed and qualified at Watkins Glen International. There was a hearing on the injunction Friday in North Carolina, and the parties had agreed in principle to settle after the hearing, a Dodge spokesman confirmed Friday night. The two sides released a statement Saturday morning: "Jeremy Mayfield, Mayfield Motorsports, Inc., and Evernham Motorsports LLC announced that they have agreed to end their relationship effective immediately. The parties agree that it is in their mutual best interests to go in different directions and wish each other success in the future." "He has been terminated, and I honestly don't want to discuss the terms with that," Evernham said.
Mayfield was replaced for this weekend's race by former Cup champion Bill Elliott on Tuesday. When contacted by NASCAR.COM, Mayfield said he knew nothing of the driver change. Evernham, however, said his team contacted Mayfield Motorsports' agent on Monday and began the discussions. There was no immediate announcement of a full-time driver in the No. 19 Dodge, although it has been speculated that Elliott Sadler will likely move to the car. Whether that will happen before the end of the season is unknown for sure, Evernham said. "The decision to make a change in the 19 had nothing to do with whether [a driver change] could or could not happen," Evernham said. "It would make the most sense if we could do that, for sure."(NASCAR.com)(8-11-2006) MORE: Jeremy Mayfield, whom Ray Evernham said he terminated on Monday, was hoping to stall the firing by getting a temporary injunction Friday. The hearing was scheduled to begin at 11:30am/et in North Carolina Superior Court in Iredell County.
"Jeremy Mayfield has been terminated,"Evernham said. "We have 2007 plans in place. We hope to be able to announce them soon."
While Mayfield is expected to drive for Bill Davis Racing beginning next year, a source familiar with the situation said that team doesn't have an immediate ride available for the driver. Evernham Motorsports, though, is looking for a driver for the rest of the season and owner Ray Evernham would welcome the chance to get a jump on 2007 if the driver he's signed for next year were to become available sooner. That driver is expected to be Elliott Sadler, who may be available by the Aug. 18-20 Michigan Cup race weekend if Robert Yates Racing grants his release after Watkins Glen. For now, Bill Elliott is in the #19 Evernham Motorsports Dodge and Sadler remains in RYR's #38 Ford. Evernham said the reasoning behind the change was simple from his perspective. "Purely the performance of the car and the team is not where it should be to represent sponsors," he said Friday. "It's out of the top 35 in points now and that was really the big trigger on making a change. We just haven't delivered as a group on what we should be doing, so we needed to make some changes." A wreck at Indy knocked the #19 team out of the top 35, meaning its not guaranteed a starting spot for the AMD at the Glen. "It's one of those where as hard as you try to turn things around if they're not working, sometimes you just have to make a change to get it to work and it's certainly not been because of a lack of effort," Evernham said. Elliott is currently scheduled to attempt two more races for Michael Waltrip Racing and three for Team Red Bull. Evernham is expected to utilize the former champion's talent as often as possible until a more permanent replacement for the #19 team is found. "The decision to make the change in the 19 had nothing to do with whether that could or couldn't happen," Evernham said of Elliott's availability. "It would make the most sense if we could do that, for sure. ... But I can tell you that just having Bill Elliott back in the car is pleasant again." A phone call to Dale Cagle, Mayfield's business agent, was not immediately returned on Friday. RYR co-owner Doug Yates isn't sure what the future holds. While it's not been announced yet, David Gilliland will take over for Sadler, either sometime this year or next. "All that just happened, so we have to look at that and see what works," Yates said of potentially releasing Sadler prior to year's end. "We haven't really talked about that right now, but I'm not saying it's out of the question." If so, would Gilliland run more than seven races, making him ineligible for rookie of the year honors in '07? "David and I have talked about that," Yates said. " ...
