A settlement has been reached in the trial brought by Richard Childress Racing (RCR) against United of Omaha insurance company in a case that arose out of the death of Dale Earnhardt at Daytona International Speedway on February 18, 2001. The jury trial began May 23, 2005, in the Superior Court in Lexington, N.C. The parties reached a confidential settlement over the weekend of June 17. The settlement was reached after both parties had presented all of their evidence and had a full understanding of the intentions of the other party. By settling the case, both parties were able to avoid further prolonged litigation which would have included appeals to the North Carolina appellate courts. Also, the settlement precludes any further disagreements or litigation by both parties over the issues and subject matter of the lawsuit.(RCR PR)(6-20-2005)
