Late Friday, attorneys for 23XI Racing and Front Row Motorsports filed a motion asking the court to dismiss NASCAR’s counterclaim accusing the teams of illegal collusion during charter negotiations.
The teams argue there’s no evidence they conspired to restrict competition and say NASCAR voluntarily negotiated both jointly and individually throughout the process.
If the court doesn’t grant summary judgment, the teams are also asking for a separate trial on the matter in 2026, noting that it would be too complex to include in the current case set for December.
The filing includes nearly 100 documents, most of them heavily redacted. However, some publicly available exhibits include contingency planning documents from NASCAR outlining potential responses if teams refused to renew charters or chose to boycott races. Those are viewable below.
