What’s in the lawsuit settlement?

Information is slowly coming out as to what was included in Thursday’s settlement between NASCAR and 23XIRacing and Front Row Motorsports.

The impact will be felt across the sport impacting both the sanctioning body and all teams. Various outlets have reported on details of the settlement, as far as they are currently known:

Charters: Both 23XI Racing and Front Row Motorsports will receive their six charters back. They will be back paid as if they were chartered teams in 2025.

Moving forward, charters for all teams will be permanent (often referred to as evergreen). The terms of the agreements will be updated at future dates (likely to correspond with media rights deals).

All Chartered teams will have to approved the changes to the terms resulting from the settlement. A meeting between NASCAR and the teams was scheduled for Thursday afternoon.

“Three-Strike Rule”: In the previous charter agreement, teams could vote against three NASCAR proposals that cost the teams money. The settlement provides for five strikes.

International Rights: In the latest Charter agreement, teams did not see any revenue from NASCAR’s international media rights deal.  That will now change to some unknown amount.

New Business Deals: Teams will be paid one-third of any new NASCAR deals that involve the teams’ intellectual property usage.

NASCAR will also pay 23XI Racing and Front Row Motorsports some unknown amount of monetary damages.
