Kevin Conway says his marketing company only agreed to pay Front Row Motorsports for 15 races and that the team still owes him money from this season. Conway drove in 21 Sprint Cup races for Front Row this season before being released in August. He had used his marketing company, Exclaim, to represent Extenze, which sponsored him and the Front Row team. Front Row has sued Conway, Exclaim and Biotab, the parent company of Extenze, for breach of contract and asked for $2.754 million. In a response filed Wednesday, Conway said that the language in the contract required payments of $150,000 per race for the first 15 races, with the remainder of the season being paid depending on revenue from product placement through its activation of the racing sponsorship. Front Row alleges that the sponsorship agreement was for $5.4 million, paid in weekly installments of $108,000, for the full season. The team claims that a clause in the contract indicates that the weekly payments would last the entire season. Conway, who was to get $540,000 for the full season (10% of the sponsorship), said in court documents that he is owed $129,600 in salary and $122,240 in purse money because he had been paid only $135,000 before he was released in August. The case was originally filed in North Carolina Superior Court but Conway has moved it to federal court. In his response, Conway also alleges that funds were diverted from his car to the other cars in the three-car stable even though Extenze was specifically sponsoring his car.
