In October 2024, 23XI Racing and Front Row Motorsports filed a federal antitrust lawsuit against NASCAR and its chairman, alleging anti-competitive practices tied to the sanctioning body’s updated charter system. The teams argued NASCAR’s control over charters and related commercial terms limited fair competition and economic opportunities for participants in the sport.
After a preliminary injunction allowing charter status in 2025 was overturned on appeal in mid-2025, the lawsuit proceeded to trial beginning December 1, 2025. On the ninth day of proceedings, the parties reached a settlement that ended the case before a jury verdict.
Under the settlement, 23XI Racing and Front Row Motorsports will retain their charters, and NASCAR will implement changes to its charter framework, including a form of evergreen (permanent) charters for all teams. Financial terms and additional details of the agreement were not publicly disclosed at the time of the settlement.
The resolution ends the year-long legal dispute and provides a basis for revised commercial terms between NASCAR and its Cup Series teams going forward.
